2. Intellectual Property and Course Content

You agree that the Site itself, as well as all content, videos, training materials, products, services and/or other materials, made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing (collectively referred to as the "Content") are maintained for your personal use and information by MKB Global Industries LLC (the "Company") and are the property of the Company and/or its third party providers. You agree that such Company Content shall include all proprietary videos, HTML/CSS, Javascript, graphics, voice and sound recordings, artwork, photos, documents, text, PDF cheat sheets, STL files, design templates, and all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes. No Company Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by the Company. Modification of the Content or use of the Content for any other purpose is a violation of the copyright and other proprietary rights of the Company and may be subject to monetary damages and penalties. You may not distribute, modify, transmit, or use the content of the Site or any Content, including any and all software, tools, graphics, STL files, and/or sound files, for public or commercial purposes without the express written permission of the Company.

3. Your Original Designs

You retain full ownership of any original designs, mechanisms, or other creative works you produce during the course. The Company makes no claim to intellectual property you create using the skills taught in the course.

4. Copyright and Trademarks

All Content, such as text, data, graphics files, videos and sound files, and other materials contained in the Site, are copyrighted unless otherwise noted and are the property of the Company and/or a supplier to the Company. No such materials may be used except as provided in these Terms of Use. All trade names, trademarks, and images and biographical information of people used in the Company Content and contained in the Site, including without limitation the name and trademark "Confident 3D Builder" and "3-Week Mechanism Builder," are either the property of, or used with permission by, the Company. The use of Content by you is strictly prohibited unless specifically permitted by these Terms of Use. If you believe that your intellectual property rights are being violated and/or that any work belonging to you has been reproduced on the Site or in any Content in any way, you may notify the Company at [email protected].

5. What You Are Purchasing

3-Week Mechanism Builder is a digital online course delivered through our platform. This is not a physical product. Upon purchase, you receive lifetime access to the course materials, including video lessons, downloadable resources, and any future updates or additions made to the course. "Lifetime access" refers to the lifetime of the course on our platform, as further described in Section 14.

6. Account and Access

You are responsible for maintaining the security of your account login. Your course access is for your personal use only. You may not share your login credentials with others or allow multiple people to access the course through a single account. The Company reserves the right to terminate your account if shared access is detected.

7. Payment and Pricing

All prices are listed in US dollars. Payment is processed securely through Stripe and/or PayPal. By completing a purchase, you authorize the charge to the payment method you provide at checkout. Prices are subject to change at any time, but any price change will not affect existing purchases.

8. Community Guidelines

If you have access to the Confident 3D Builder private community, you agree to treat all members with respect, refrain from spam or self-promotion unless permitted, and not share course materials within the community or elsewhere. You agree not to harass, bully, threaten, or engage in any abusive behavior toward other community members. If you experience or witness inappropriate behavior within the community, you may report it to [email protected]. The Company reserves the right to investigate reports and remove any member from the community at its sole discretion, with or without notice, and without refund.

9. Electronic Communications Consent

When you register with the Company and/or this Site, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from the Company. You consent to receive notices electronically by way of transmitting the notice to you by email.

10. User Submissions

If you send comments, suggestions, feedback, or designs about the Site or Course to the Company, including but not limited to notes, text, drawings, images, designs, or computer programs, such submissions shall become and shall remain the sole property of the Company. No submission shall be subject to any obligation of confidence on the part of the Company. The Company shall exclusively own all rights to and shall be entitled to unrestricted use, publication, and dissemination as to all such submissions for any purpose, commercial or otherwise, without any acknowledgment or compensation to you. This does not apply to original mechanisms or designs you create during the course for your own personal use, which remain your property as stated in Section 3.

11. Course Content and Updates

Confident 3D Builder reserves the right to update, modify, add to, or remove course content at any time to improve the learning experience. Pre-launch students may receive content on a rolling basis as the course is being built. The Company uses reasonable efforts to include accurate and up-to-date information in the Site but makes no warranties or representations as to its accuracy. The Company assumes no liability or responsibility for any errors or omissions in the content of the Site.

12. No Professional Engineering Advice

3-Week Mechanism Builder teaches hobbyist-level 3D printing and mechanical design skills for personal use. Nothing in this course constitutes professional engineering advice. The designs and techniques taught are for educational and personal hobby purposes only. Confident 3D Builder is not responsible for any outcomes resulting from the application of course content, including but not limited to failed prints, damaged equipment, or parts used in unintended applications.

13. Physical Safety and Assumption of Risk

3D printed objects created using skills taught in this course are produced by you on your own equipment using your own materials. The Company has no control over your printing conditions, material choices, printer calibration, post-processing, or how you use the objects you create. 3D printed parts may contain small components that can break, detach, or degrade over time. You assume all risk and responsibility for the physical safety of any objects you design, print, and assemble during or after this course. You are solely responsible for ensuring that your printed objects are used safely and kept away from children, pets, or any situation where small parts could pose a choking, injury, or other safety hazard. The Company shall not be liable for any injury, damage, loss, or harm of any kind — to persons, animals, or property — resulting from objects you create using the skills, techniques, or designs taught in this course.

14. Service Availability and Business Continuity

The Company intends to provide ongoing access to course materials for the foreseeable future. However, "lifetime access" refers to the lifetime of the course on our platform, not a guarantee of perpetual availability. The Company reserves the right to discontinue, suspend, or modify the platform, course, or community at any time for any reason, including but not limited to business closure, technical limitations, or circumstances beyond the Company's control. In the event the Company permanently discontinues the course, the Company will make reasonable efforts to provide enrolled students with advance notice and, where feasible, downloadable versions of course materials. The Company is not obligated to maintain the platform, course, or community indefinitely. Planned future content, including but not limited to additional project paths, is offered on a good-faith basis and is not guaranteed.

15. Third Party Software Licensing

This course uses Autodesk Fusion (formerly Fusion 360) for CAD instruction. Autodesk offers a free Personal Use license that is available for home-based, non-commercial design and fabrication projects. This license is suitable for hobbyists following along with this course for personal learning purposes. The Company does not provide, manage, or guarantee access to Autodesk Fusion or any other third party software. You are solely responsible for obtaining and maintaining the appropriate software license for your use case. If you intend to use designs created during the course for commercial purposes, including but not limited to selling printed products, offering design services, or generating revenue exceeding $1,000 USD annually, you are responsible for obtaining the appropriate commercial license directly from Autodesk. The Company is not responsible for any licensing violations, fees, or legal consequences resulting from your use of third party software. For full licensing details, visit autodesk.com. The Company is not responsible if any third party software provider changes its licensing terms, pricing, features, or availability at any time. Should any software used in this course become unavailable or change its terms, the Company may update course materials to reflect alternative tools but is not obligated to do so.

16. Data Security

The Company shall use commercially reasonable efforts to restrict unauthorized access to our data and files. However, no system whether or not password protected can be entirely impenetrable. You acknowledge that it may be possible for an unauthorized third party to access, view, copy, modify, or distribute the data and files you store using the Site. Use of the Site is completely at your own risk.

17. Privacy

The Company will not intentionally disclose any personally identifying information about you to third parties, except where the Company, in good faith, believes such disclosure is necessary to comply with the law or enforce these Terms of Use. By using the Site, you signify your acceptance of the Company's Privacy Policy. If you do not agree with this Privacy Policy, in whole or part, please do not use this Site.

18. Refunds

Our refund terms are outlined in our Refund Policy page. By purchasing the course, you agree to the refund terms stated there.

19. Chargebacks

If you have a concern about your purchase, you agree to contact us at [email protected] before filing a dispute or chargeback with your bank or credit card company. Filing a chargeback without first contacting the Company may result in permanent revocation of your course and community access. The Company reserves the right to dispute any chargeback filed without prior contact.

20. Pre-Launch Promotional Terms

3-Week Mechanism Builder is currently available for pre-launch purchase. Pre-launch buyers receive immediate access to the Confident 3D Builder community upon account creation. Course content will be delivered beginning on the launch date of May 18, 2026. The current pre-launch offer includes 50% off the standard course price ($99 instead of $199), immediate access to the Confident 3D Builder community, Early Adopter Influence allowing pre-launch students to provide feedback that shapes the final course, and free access to all future project paths added to the course at no additional cost. This promotional pricing is available until 11:59 PM Eastern Time on May 17, 2026 and may be modified or ended at any time at the discretion of the Company. Pre-launch students who purchase during this promotional period will retain all stated benefits regardless of future price changes. Future project paths are offered on a good-faith basis and are subject to the terms described in Section 14. The 7-day satisfaction guarantee begins on the course launch date (May 18, 2026), not the date of purchase. If the Company determines that the course will not proceed to full production, all pre-launch purchasers will receive a full refund of their purchase price within 14 business days. The Company reserves the right to cancel the course launch at any time prior to the launch date.

21. Limitation of Liability

NEITHER THE COMPANY NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR MAINTAINING THE SITE AND/OR ANY CONTENT ON THE SITE SHALL BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO OR USE OF THE SITE. WITHOUT LIMITING THE FOREGOING, ALL CONTENT ON THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE COMPANY DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF THE MATERIALS IN THE SITE, THE RESULTS OF THE USE OF SUCH MATERIALS, THE SUITABILITY OF SUCH MATERIALS FOR ANY USER'S NEEDS, OR THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR CORRECTION. THE COMPANY DOES NOT WARRANT THAT THE USE OF THE MATERIALS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE, THE CONTENT, AND/OR THE MATERIALS AVAILABLE ON THIS SITE ARE FREE FROM BUGS OR VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME ALL RESPONSIBILITY FOR THE COST OF ALL NECESSARY REPAIRS OR CORRECTIONS. PLEASE NOTE THAT THE APPLICABLE JURISDICTION MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. SOME OF THE ABOVE EXCLUSIONS MAY THUS NOT APPLY TO YOU.

22. Third Party Services

THE COMPANY SHALL NOT BE RESPONSIBLE FOR ANY PERFORMANCE OR SERVICE PROBLEMS CAUSED BY ANY THIRD PARTY WEBSITE OR THIRD PARTY SERVICE PROVIDER (INCLUDING, FOR EXAMPLE, YOUR WEB SERVICE PROVIDER, STRIPE PAYMENT SERVICES, PAYPAL PAYMENT SERVICES, AUTODESK FUSION SOFTWARE, YOUR 3D PRINTER MANUFACTURER, SLICER SOFTWARE, AND/OR ANY UPDATES OR UPGRADES TO THAT SOFTWARE). ANY SUCH PROBLEM SHALL BE GOVERNED SOLELY BY THE AGREEMENT BETWEEN YOU AND THAT PROVIDER.

23. Indemnification

You agree to indemnify and hold the Company and each of its directors, officers, employees, and agents harmless from any and all liabilities, claims, damages, and expenses, including reasonable attorney's fees, arising out of or relating to (i) your breach of this Agreement, (ii) any violation by you of law or the rights of any third party, (iii) any materials, information, works and/or other content of whatever nature or media that you post or share on or through the Site, (iv) your use of the Site or any services that the Company may provide via the Site, and (v) your conduct in connection with the Site or the services or with other users of the Site or the services.

24. Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to any principles of conflicts of law. You further submit to the exclusive jurisdiction of the state and federal courts sitting in Virginia.

25. Severability

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
